Everton are querying why compensation claims against them
from Burnley, Leeds and Leicester will be heard by the same disciplinary panel
that docked them 10 points last week.
The club are appealing against a punishment they described
as 'disproportionate and unjust' and eyebrows have been raised by fact that
their rivals' claims will be determined by the same panel, particularly as the
chair of the commission David Phillips KC has previously acted for Leeds.
Everton's appeal will be heard by a different panel
assembled by the Premier League's Appeals Board, but the claims for
compensation will be decided by the same people who found the club guilty.
The case from Burnley, Leeds and Leicester is based on the
fact that they were relegated to the Championship during seasons in which
Everton were found guilty of breaching the Premier League's spending rules,
which they claim entitles them to compensation of up to £100m each.
In an interim hearing that took place last May Phillips
ruled that the three clubs had a case, writing in a judgement published last
week: 'I am satisfied that the applicant clubs have potential claims for
compensation.'
The three-person panel is completed by judge Alan Greenwood
and chartered accountant Nick Igoe, a former finance director at West Ham.
Phillips acted for Leeds in their appeal against a 15-point
deduction imposed by the EFL for breaking insolvency rules in 2007.
The leading barrister also has history with Everton, having
sat on the independent panel that fined the club a record £300,000 following
pitch invasions that marred a Premier League win over Crystal Palace at
Goodison Park in May 2022.
Everton have nine more days to submit their appeal, which
the Premier League have indicated will take place before the end of the season.
The clubs demanding compensation for being relegated during
seasons in which Everton breached spending rules have 23 days to submit a
formal claim, which is expected to be heard after the appeal.
Everton declined to comment.
